Golfer's Insurance Policy

Please read this Policy carefully upon receipt and promptly request the Company for necessary amendments.

Whereas the Insured (not being a professional golf player) named in the Schedule, by a written Proposal and Declaration which shall be the basis of this Contract and is deemed to be incorporated herein, has applied to Tugu Insurance Co. Ltd. (hereinafter called the "Company") for the insurance hereinafter contained and has paid or agreed to pay the premium mentioned in the Schedule as consideration for such insurance.

Now this policy witnesseth that in respect of any of the specified Contingencies occurring during the period of insurance within the Territorial Limit stipulated in the Schedule, the Company will, subject to the terms, exceptions and conditions contained herein or endorsed hereon, indemnify the Insured in the manner and to the extent hereafter provided.

Contingencies

Section I - Liability to Third Party

The Company will indemnify the Insured against

  1. all sums which the Insured shall become legally liable to pay for compensation in respect of
    1. accidental bodily injury to third party
    2. accidental damage to Property belonging to third party
    happening during the Period of Insurance and caused by the Insured whilst and as a consequence of playing or practising golf at any recognised golf club, course or driving range
  2. all costs and expenses of litigation recovered by any claimant against the Insured
  3. all costs and expenses of litigation incurred with the written consent of the Company in respect of a claim against the Insured for compensation to which the indemnity expressed in this Section applies

Provided that the liability of the Company under this Section for all compensation(inclusive of all costs and expenses of litigation incurred) payable to any claimant or any number of claimants in respect of or arising out of any one occurrence or in respect of or arising out of all occurrences of a series consequent on or attributable to one source or original cause shall not exceed the Limit of Indemnity specified in Section I of this policy.

In the event of the death of the Insured, the Company will, in respect of the liability incurred by the Insured, indemnify the Insured's personal representatives in the terms of and subject to the limitations of this Section provided that such personal representatives shall act as though they were the Insured observe fulfil and be subject to the terms, exceptions and conditions of the Policy so far as they can apply.

Exceptions to Section I

The Company will not indemnify the Insured in respect of liability consequent upon

  1. bodily injury to any member of the Insured's family or in the employ or service of the Insured except for caddies
  2. any agreement by the Insured to pay any sum by way of indemnity or otherwise unless such liability would have attached in the absence of such agreement
  3. damage to property belonging to or held in trust or in the custody or control of the Insured or any member of the Insured's family, or in the control of any person in the service of the Insured
  4. bodily injury or property damage arising out of the Insured's business or the ownership or control of mechanically propelled vehicles or watercraft, other than golf carts and electrically driven buggies.

Section II - Personal Accident

If during the Period of Insurance the Insured whilst on any recognised golf club, course or driving range for the purpose of playing or practising golf shall sustain bodily injury caused solely by violent accidental external and visible means, the Company will pay to the Insured or in the event of his/her death to his/her Executors or Administrators, the sum or sums of money hereinafter specified provided such injury shall solely and independently of any other cause resulting within twelve months from the occurrence thereof


1. Death HK$500,000.00
2. Total and permanent loss of all sight in one or both eyes HK$500,000.00
3. Total loss by physical severance of or total and permanent loss of use of
  1. one or two limbs
  2. one or both hands
  3. arm above the elbow
  4. arm at or below the elbow
  5. leg above the knee
  6. leg at or below the knee
HK$500,000.00
4. Medical Expenses actually incurred as a result of Bodily Injury above-mentioned HK$ 10,000.00

Provided that the total sum payable under this Section in respect of all injuries sustained during any one Period of Insurance shall not exceed the Sum Insured specified in Section II of this policy.

Exceptions to Section II
  1. Death or Bodily Injury attribute to:
    1. suicide or attempted suicide, wilful exposure to needless peril except in an attempt to save human life
    2. pre-existing physical or mental defects or infirmities drug or alcohol abuse
    3. gradually operating causes
    4. the use of drugs unless taken in accordance with a medical prescription and not for treatment of drug addiction
    5. pregnancy, childbirth, sickness or disease.
  2. Death or Bodily Injury sustained by any Insured Person under 18 years or over 65 years of age.

Section III - Golfing Equipment

The Company will indemnify the Insured against accidental loss of or damage to golfing equipment including golf clubs, golf bags, trolleys (not motorised) and other golf equipment (excluding golf balls unless lost with the clubs or bag) belonging to the Insured whilst practising or playing golf at any recognised club, course or driving range, or whilst in the course of a direct journey to or from such club, course or range for the purpose of playing or practising golf.

Provided that the liability of the Company under this Section in respect of all loss or damage occurring during any one Period of Insurance shall not exceed the Sum Insured specified in Section III of this policy.

Exceptions to Section III

The Company shall not be liable in respect of

  1. loss or damage caused by or resulting from wear and tear or deterioration
  2. loss of or damage directly occasioned by pressure wave caused by aircraft or other aerial devices travelling or sonic or supersonic speeds
  3. loss of or damage to golf balls in play or in practice.
Limit Per Article

The liability of the Company shall limit to HK$2,000.00 in respect of each and every single article.

Deductible

The Company shall not be liable for the first HK$250.00 in respect of each and every loss.

Section IV - Personal Effects

The Company will indemnify the Insured against accidental loss of or damage to Personal Effects belonging to the Insured whilst practicing or playing golf within any recognised golf club, course or driving range.

Provided that the liability of the Company under this Section in respect of all losses or damage occurring during any one period of insurance shall not exceed the Sum Insured specified in Section IV of this policy.

Exceptions to Section IV

The Company shall not be liable in respect of loss of or damage to mobile phones, portable computers, cameras, pens, lighters, watches, jewellery, furs, trinkets, medals, coins, money, cheques, cheque cards, cash cards, credit cards, stamps, documents or securities of any kind.

Limit per Article

The liability of the Company shall limit to HK$2,000.00 in respect of each and every single article.

Pairs and Sets Clause

Where any insured item consists of articles in a pair or set, the Company's liability shall not exceed the value of any particular part or parts which may be lost or damaged, without reference to any special value which such article or articles may have as part of such pair or set, nor more than a proportionate part of sum insured hereby on such pair or set.

Deductible

The Company shall not be liable for the first HK$250.00 in respect of each and every loss.

Section V - Hole-in-One Expenses

The Company will indemnify the Insured for the cost of hospitality in any recognised golf club, which by local tradition he/she is required to extend to members in the event of the Insured 'holing out in one' up to the Limit of Indemnity as specified in Section V of this policy subject to evidence in the form of signed/countersigned score card recording the event. Receipt will be required for proof of expenses.

Jurisdiction Clause

The Indemnity given by Section I of this policy shall not apply in respect of judgements which are not at the first instance delivered by or obtained from a Court of competent jurisdiction in Hong Kong.

General Exceptions

  1. The Company shall not be liable under this Policy for any loss destruction damage liability or bodily injury directly or indirectly caused by or contributed to by or arising from
    1. war invasion act of foreign enemy hostilities whether war declared or not civil war rebellion revolution insurrection or military or usurped power riot strike or civil commotion
    2. volcanic eruption subterranean fire earthquake or other convulsion nature.
  2. The Company shall not be liable in respect of
    1. any loss or destruction of or damage to any property whatsoever or any loss or expense whatsoever resulting or arising therefrom or any consequential loss
    2. any legal liability of whatsoever nature
    directly or indirectly caused by or contributed to by or arising from
    1. ionising radiations or contamination by radioactivity from any nuclear fuel or from any nuclear waste from the combustion of nuclear fuel and for the purposes of this exception combustion shall include any self-sustaining process of nuclear fission
    2. nuclear weapons material.
  3. Unless specifically extended by the Company cover under this Policy shall not commence until the Insured has attained the age of 16 years and shall cease to be operative upon the Insured attaining the age of 65 years.
  4. This Policy does not cover and no section of this Policy shall apply in respect of any claim arising directly or indirectly from any injury illness death loss expense or other liability attributable to HIV (Human Immunodeficiency virus) and/or any HIT related illness including Aids (Acquired Immune Deficiency Syndrome) and/or any mutant derivative or variations thereof however caused.

General Conditions

  1. Every notice or communications to be given or made under this Policy shall be delivered in writing to the Company.
  2. The due observance and fulfillment of the terms provisions conditions and endorsements of this Policy in as far as they relate to anything to be done or complied with by the Insured and the truth of the statements and answers in the Proposal shall be conditions precedent to any liability of the Company to make any payment under this Policy.
  3. The Insured shall exercise reasonable care and shall take all reasonable precautions to prevent accidents and shall comply with all statutory or other regulations.
  4. The Insured shall give notice to the Company of any injury loss or damage as soon as possible after it comes to the knowledge of the Insured or of the Insured's representative for the time being.    The Insured shall forward to the Company forthwith after receipt thereof every written notice or information as to any verbal notice of claim and shall also give notice to the Company immediately he receives knowledge of any proceedings.    The Insured shall use the best endeavours to preserve any damaged or defective appliances or things which might prove necessary or useful by way of evidence in connection with any claim and so far as may be reasonably practicable no alteration or repair shall be made without the consent of the Company after any accident occurring in connection therewith until the Company shall have had an opportunity to inspect the damage.    The Insured shall give all necessary information and assistance and forward all documents to enable the Company to investigate settle or resist any claim as the Company may think fit.
  5. The Insured shall not incur any expense whether by litigation or otherwise or make any payment settlement arrangement or admission of liability in respect of any claim for which the Company may be liable under this Policy without the written authority of the Company.    The Company shall be entitled to use the name of the Insured for all purposes in connection with this Policy including bringing defending enforcing or settling of legal proceedings for the benefit of the Company.    In connection with any one claim or number of claims arising out of any one cause for indemnity against liability as defined in this Policy the Company may at any time pay to the Insured the Limit of Liability after deduction of any sum or sums already paid as compensation or any less amount for which such claim or claims can be settled and upon such payment being made the Company shall relinquish the conduct and control of and be under no further liability in respect of such claim or claims except the payment of costs and expenses of litigation recoverable or incurred in respect of matters prior to the date of such payment and the Company shall not be responsible for any loss alleged to have been sustained by the Insured in consequence of any action or omission of the Company in connection with such claim or proceedings.
  6. If at the time any claim arises under the Policy there is any other existing Insurance covering the same liability the Company shall not be liable to pay or contribute more than ratable proportion of such claim.
  7. This policy may be terminated:
    1. at any time by the Insured on notice to that effect being given in writing to the Company.
    2. by the Company on notice seven day's advance notice to that effect being given in writing to the Insured's last known address, in which case the Company shall be liable to repay on demand a ratable proportion of the premium for the unexpired term from this date of the cancellation.
  8. If any difference shall arise out of this Policy, such difference shall be referred to arbitration in accordance with the laws in force in Hong Kong. Where any difference is by this condition to be referred to arbitration the making of an award shall be a condition precedent to any right of action against the Company.
  9. If any claim made under this Policy is in any respect false or fraudulent or if any false or fraudulent devices are used to obtain benefit under the Policy, then all benefit shall be forfeited and the Policy cover immediately terminated.
